Terms of Use
These Terms of Use ("Terms") are an agreement between you and ANKO SOLUTIONS LLC ("we", "us") and govern your use of the Blackjack Owl: Card Counting mobile app (the "App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live if higher, to use the App.
2. Practice and education only
The App teaches blackjack strategy and card counting for practice and entertainment. It does not offer real-money gambling, betting or any opportunity to win money or prizes. Chips and balances in the App have no monetary value and cannot be exchanged for anything.
Strategy and card counting do not guarantee winnings. Gambling involves risk of loss. Casinos may restrict or refuse play to players they believe are counting cards, and laws on gambling and using devices in casinos vary by location. You are responsible for following the laws and venue rules that apply to you. Do not use the App or any device at a casino table. If gambling is causing you problems, contact a support service such as 1-800-GAMBLER (US) or BeGambleAware (UK).
3. Subscriptions and free trials
- Some features require a paid auto-renewing subscription. The price, billing period and any free trial are shown in the App before you buy.
- Payment is charged to your Apple ID account when you confirm the purchase, or at the end of the free trial if you started one.
- The subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- If you cancel during a free trial, you will not be charged. Any unused part of a free trial is forfeited when you buy a subscription.
- You can manage or cancel subscriptions in your device's Settings → [your name] → Subscriptions. Deleting the App does not cancel a subscription.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. See our Refund Policy.
- We may change prices. Changes apply from your next renewal, and Apple will notify you where required.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by Apple's Usage Rules. The App and its content, including lessons, drills, design and trademarks, belong to us or our licensors.
5. Acceptable use
You agree not to copy, modify, reverse engineer or resell the App; not to interfere with its operation or security; not to bypass payment or access restrictions; and not to use the App for any unlawful purpose.
6. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted or error-free, or that its content will produce any particular results.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any gambling losses or other losses of money, data or profits arising from your use of the App. Our total liability for any claim is limited to the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
8. Termination
We may suspend or end your access to the App if you breach these Terms. You may stop using the App at any time by deleting it and cancelling your subscription.
9. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation. Apple is not responsible for any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to US government embargo and are not on any US government list of prohibited or restricted parties.
10. Changes
We may update these Terms. We will post the new version on this page and change the effective date. Continuing to use the App after changes take effect means you accept them.
11. Governing law
These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-law rules. Any dispute will be subject to the exclusive jurisdiction of the courts of Dubai. This does not deprive you of the mandatory consumer protections and the right to bring proceedings in the courts of your country of residence, where the law of that country provides them.
